Under pressure from Supreme Court of India, which had on May 1st directed that Army should use the option of proseting the five soldiers accused of murder and mayhem at Pathribal, in south Kashmir, either in a military court or a civil court, within two months, Army has now filed an affidavit at court of Chief Judicial Magistrate Srinagar and obtained order of holding a court marshal. Mr Rajiv Gupta, according to well placed authoritative sources, has granted the permission.This has put to end years of legal battle between Army [which argued that the soldiers in J&K had immunity under AFSPA] and CBI [which had concluded in its 6-year-long investigation in 2006 that all the five killed in the fake encounter were innocent civilians and contended that armed forces could not claim AFSPA immunity for plain murders which were not part of their counter-insurgency opearions].
